Following a three-day trial in the King’s Bench Division of the High Court, Arax Law has obtained judgment for the Claimant, and the dismissal of the Defendant’s counterclaim, in the case of MSA Properties Ltd v The Drapery Northampton Ltd [2026] EWHC 1420 (KB). The judgment contains a helpful analysis of the interplay between the Landlord’s right of access to demised premises for the purposes of carrying out essential works and the Tenant’s right to the quiet enjoyment of its demised premises.
